The DUI Process

Whenever you are arrested for DUI there is actually two areas that you have to deal with. You have the criminal action which most people know about. But the second action deals with the department of motor vehicles that's a civil action against your driver's license. While they sort of intertwine, they are distinctly separate. In a criminal action you're prosecuted for the purposes of putting you in jail, fining you, placing you on probation with additional restrictions, and sometimes crossing over into suspending of your driver's license. In a department of motor vehicles hearing the only issue involved is the taking away of your driver's license. It's imperative that you contact the department of motor vehicles within ten days of the date you were arrested. And that means either you directly or your lawyer.
